Guidelines for the issuance of Certificates of Tradition and Freedom, of NonOwnership and Consultation of Owners' Indexes

On April 24, 2023, the Superintendence of Notaries and Registry issued Resolution No. 03915 by which new guidelines were established for the provision of services related to the issuance of Certificates of Tradition and Freedom, Certification of Non-Ownership and Consultation of Index of Owners due to the fact that, after a technical and legal analysis, several problems were detected with the private operators authorized for the intermediation in the sale of these documents.

Therefore, the Entity will facilitate the acquisition of the Certificates through the following modalities,

which will allow citizens to have virtual access to the records in a direct, easy and reliable manner:

  1. Direct purchase on the web page of the Superintendency of Notaries and Registries:  Direct purchase on the web page of the Superintendence of Notaries and Registry: Individuals and/or legal entities may purchase documents directly on the web page of the Superintendence of Notaries and Registry https://www.supernotariado.qov.co/. This website will allow the citizen to make the payment, without any intermediary, and the document and respective voucher will be sent to the e-mail previously indicated.
  • Self-consumption: Purchase in the Notary's Offices: The Notary's Offices will be empowered to physically issue the Certificates, once they have requested authorization from the Superintendence of Notaries and Registry, by means of a physical post in which the image of authorization by the Entity is displayed:
    • Certificate of existence and legal representation in force or certificate of commercial registration, when applicable, in which the economic activity is directly related to the real estate, construction, financial and/or compensation fund sectors;
    • Single Tax Registry in which the economic activity is directly related to the real estate, construction, financial and/or compensation fund sectors;
    • Copy of the citizenship card of the legal representative of the legal or natural person, and/or of the foreigner's identity card;
    • Access authorization request form, described in Annex 1 of Resolution No. 03915.

In order to proceed with this modality, individuals and/or legal entities must pay in advance the amount corresponding to nineteen thousand two hundred pesos ($19,200).

3.Purchase at the Notary's Offices: The Notary's Offices will be empowered to physically issue the Certificates, once they have requested authorization from the Superintendence of Notaries and Registry, through a physical post in which the image of authorization by the Entity is displayed.

For this purpose, the following documents must be attached:

  • Copy of the notary's citizenship card;
  • Authorization request form, described in Annex 1 of Resolution No. 03915.

It is important to point out that notaries may not charge additional values to those indicated by the Entity, under penalty of the definitive cancellation of this authorization.
