Support for the generation of employment for young people as part of the Sacúdete Strategy

Last June 24, Decree Number 688 of 2021 was issued, "whereby Section 10 is added to Chapter 1 of Title 6, Title 6 of Part 2 of Book 2 of Decree 1072 of 2015, Sole Regulatory Decree of the Labor Sector and support is created for the generation of employment for young people within the Sacúdete Strategy".

The purpose of the same is to create the support for the generation of employment that will grant to the contributors that make contracts or linkages in 2021, a monthly contribution that will correspond to twenty-five percent (25%) of one (1) legal monthly minimum wage in force (SMLMV), for additional workers between 18 and 28 years of age, and up to twelve (12) times within the term of the support, in order to generate young and formal employment in the country.

Now, regarding the beneficiaries of the support for the generation of employment, it was established that legal entities, natural persons, consortiums, temporary unions, autonomous patrimonies and cooperatives, which prove their status as employers through the Integrated Contribution Settlement Form - PILA, may be eligible, as well as associated work cooperatives, provided that they prove the payment of the contributions of the associated workers to the Integral Social Security System.

The beneficiaries must have a deposit product, either in a financial institution supervised by the Financial Superintendency of Colombia or in a savings and credit cooperative supervised by the Superintendency of Solidarity Economy that is authorized to offer deposit products.

Entities or companies in which the participation of the Nation and/or its decentralized entities is greater than 50% of their capital may not be beneficiaries of the support.

The beneficiaries of the support will be subject to the following rules:

1. For the purpose of counting the additional workers, the number of employees for which each employer or the worker cooperative responsible for the payment of the contributions in the specific case of its associated workers, had contributed for the month of March 2021, whose contributions must have been paid before the maximum date of each application, will be taken as a reference and will be considered, of the number of additional workers that are contributing in the Integrated Contribution Settlement Form -PILA in the month of the support, those that are between 18 to 28 years of age, with a base contribution income of at least one (1) SMLMV, and that are affiliated to the Integral Social Security System in all the corresponding subsystems. These conditions apply equally to both dependent workers and associated workers.

2. In the case of new companies or new cooperatives and in order to count the workers who are the object of the support, dependent employees will be taken into account, and in the case of worker cooperatives, dependent and associated workers between 18 and 28 years of age, for whom the beneficiary has contributed a full month to the General Social Security System in the PILA, with a base contribution income of at least one (1) SMLMV, and who are affiliated in all the corresponding subsystems.

3. In no case may a person who appears as a contributor also be counted as an employee subject to this support. Likewise, each employee may only be counted once.

4. In cases where there are multiple employers of the same worker, the support will be granted to the first one that makes the respective application, and this is verified by the Special Administrative Unit for Pension Management and Parafiscal Contributions of the Social Protection  UGPP.

5. Employees who have been subject to an employer substitution under the terms of articles 67 and 68 of the Substantive Labor Code, may not be considered as beneficiaries for the calculation of the support, since no new employment is being generated.

6. For workers in the month of March 2021, it will be verified that, if the novelty of temporary suspension of employment contract or unpaid leave was applied, it was for a term less than or equal to fifteen (15) days.

Temporary support for the generation of employment for young people within the Sacúdete Strategy:

The support will apply to contributors who have made hires or linkages during the 2021 fiscal year. The support for the generation of employment will be available during the fiscal years 2021 and 2022, the beneficiaries may only receive this support once per month of application and up to a maximum of twelve (12) times without exceeding December 31, 2022.
