Orange Law, an initiative to promote the creative economy

The bill better known as "Orange Law", pending to be discussed in the first debate in the House of Representatives, and whose rapporteur is Senator Iván Duque, seeks to develop, promote, encourage, encourage and protect the creative industries as those industries that generate value because of their goods and services, which are based on intellectual property, such as Architecture, Visual and Performing Arts, Crafts, Film, Design, Publishing, Research and Development, Games and Toys, Fashion, Music, Advertising, Software, Television, Radio and Video Games.

Thus, the effective application of the "Orange Law" will be subject to the following seven strategies, better known as the 7i:

  • Information: this strategy seeks to promote an adequate gathering of information on the sectors of the creative economy.
  • Institutions: It seeks to coordinate an administrative management that involves the public, private, mixed and non-governmental sectors, in order to articulate the postulates of the Creative Economy.
  • Industry: It seeks to strengthen the role of the creative industries, as well as their formalization in order to privilege and support the gross domestic product (GDP);
  • Infrastructure: This strategy seeks to prioritize investment in physical and virtual infrastructure to support the creative economy.
  • Integration: This strategy seeks to provide the creative economy industries with access to international markets, thus strengthening their exports.
  • Inclusion: seeks to turn the creative industries into vehicles for integration and resocialization, generating economic and employment opportunities.
  • Inspiration: aims to promote participation in both national and international scenarios that allow national talent to be showcased.
  • Such strategies must be implemented hand in hand with the National Government, which will take the necessary measures so that the creative industries are encouraged, protected and recognized as a generator of employment and an engine of development. To this end, the bill provides, among other policies, the creation of credit lines for this industry through Bancoldex, as well as increasing the availability of seed capital and entrepreneurial capital. It also proposes the consolidation of the "Created in Colombia" seal to identify creative goods and services developed in the country by Procolombia and the Colombia Country Brand.

Finally, the National Government must identify tax incentives for natural and legal persons that sponsor and/or sponsor the activities defined within the Creative Economy sectors. Therefore, the role of the State is fundamental for the formulation of a Comprehensive Policy for the Creative Economy - Orange Policy - with a view to developing the "Orange Law" and duly executing its postulates and objectives.
